A woman must pay a millionaire compensation to a construction company after demolishing a structural wall of a building located in Las Condes, Metropolitan Region.
María Páez, who lives on the fourth floor, tried to enlarge her terrace to join it with the apartment’s loggia, putting the entire structure at risk. Thus, the construction company Moller y Pérez Cotapos had to carry out the repair urgently, for which she sued the owner.
The Court of Appeals of Santiago confirmed the sentence of the accused, who must pay 360.92 UF (more than 13 million pesos) to the company for emerging damage concept caused by putting the stability of the building is at risk.
“Without authorization or municipal permits, (Páez) demolished the concrete wall that separates the terrace from the apartment loggia, without consulting plans or qualified specialists, which constitutes a very serious fact, since it affects all the stability of the building or part of it”, the company reported.
Specific, the person involved damaged a concrete beam “which is part of the structure of the building and is essential to support its area.”
In this way, the court of appeal confirmed the contested sentence, issued by the 21st Civil Court of Santiago.
“The factual and legal arguments that constitute the allegations (…) they fail to distort, in the opinion of these judges, the foundations taken into consideration by the court a quo to resolve in the way it did, which, consequently, are shared,” the ruling states.
Carmen, who moved around that time to the apartment located just below Páez’s, told MON that “I had to wait around 15 days while the neighbor fixed the problem because she decided to tear down a structural wall, from the kitchen to the loggia.”
“My apartment was in danger, since it was a structural modification. What would have happened if the terrace fell on me?” he remarked.
