The Criminal and Correctional Chamber of the 8th Nomination of the city of Córdoba announced the reasons for the sentence of Roberto Carmona to life imprisonment for the crimes of escape, qualified robbery for use of a weapon and double qualified homicide for treachery and criminis causae, that is, to commit another crime.
Regarding the treachery, the court indicated that “the victim, Javier Rodrigo Bocalón, had his back turned to his attacker,” driving his taxi, so Carmona “acted safely.”
“There is no doubt that with his actions he illegitimately took her away from Bocalón, without any mitigating circumstances working in his favor,” emphasized the chambermaid Eugenio Pérez Moreno about the third life sentence that falls on the 62-year-old murderer, who was defined with a popular jury.
Regarding the aggravating circumstance for crimis causae, the court noted that the murderer “did not hesitate to stab the victim several times” from the moment he got into the taxi, “having the opportunity not to do so.”

“The conduct displayed by the accused appears directed exclusively at the elimination of the only obstacle that was presented to him in his task, which was to take possession of the victim’s vehicle, at any cost. All these circumstances are revealing of the subjective component required by the figure of qualified homicide criminis causa,” indicated the magistrate.
Eugenio Pérez Moreno, author of the vote, added that Carmona acted with the intention of killing the taxi driver so that he could carry out the theft of the vehicle to consummate his escape plan.

When assessing the aggravating circumstances of the sentence, the court highlighted the “audacity shown by acting on all the facts in broad daylight.” In addition, he pointed out that the victims attacked were in all cases “people who were defenseless on public roads.”
According to member Pérez Moreno, the selection of public transport drivers as victims “translates the use of the particular exposure to which both taxi drivers and taxi drivers are subjected – and cannot avoid them; situation cowardly taken advantage of by this type of crime.”
