Two convicted of rape acquitted in Córdoba and Almería

The Superior Court of Justice of Andalusia (TSJA) this Monday acquitted two men – one in Córdoba and the other in Almería – found guilty of allegedly raping and sexually assaulting their romantic partners, respectively.

In the case of Córdoba, the ruling released this Monday by the TSJA declares it proven that the sexual relations were consensual and that, after them, a “discussion of unclarified content” took place. For this reason, the man whom the Provincial Court of Córdoba had sentenced to nine years in prison by rape of his romantic partner has been acquitted. Apart from the crime of sexual assault, the TSJA acquits the accused of threats, who had been sentenced to nine months in prison for the alleged display of a knife during the subsequent discussion.

On the other hand, in Almería, the Superior Court of Justice of Andalusia (TSJA) has also revoked the sentence of eight years and eight months in prison for crimes of sexual assault and injuries imposed on a man convicted of raping his partner after hitting her, consider that there are “serious doubts” about the reality of this sexual assault.

The original sentence of the Almería Court considered it proven that the accused was in a park near the beach of Balerma (Almería) with the woman who had been his romantic partner for the last two years. However, the Andalusian high court fully upholds the appeal of the convicted man’s defense and now establishes that, indeed, the couple stayed that day and at that time in the aforementioned Balerma park, but eliminates all references to the use of force prior to sexual relations.
