While reforming Law P No. 5106, which regulates the Administrative Procedural Code of the Province of Río Negro, is a duly founded need and taking into account the Project presented in June 2023 that promotes the total replacement of the text of Law P nº 4142 -Procedural, Civil and Commercial Code of the Province of Río Negro- thus creating a new Civil and Commercial procedural Code, which led to the convocation of the Interpowers Commission of the Province, which is represented by the Bar Associations of the different Judicial Districts, the College of Magistrates, representatives of the three Powers of the State, among others, legitimizing the need to reform the Administrative Procedural Code.

The need to reform the Administrative Procedural Code has to do with an update of the administrative procedural regulations because, since its sanction in 2016 (eight years), the Legislature of the province of Río Negro has sanctioned various procedural laws such as which regulates the Autocompositive Methods of Conflict Resolution or the comprehensive modification to the Labor Procedure Law and the Mining Procedure Code.

A point to be addressed is the new scenario produced by the COVID 19 epidemic, forcing the Superior Court of Justice to issue various regulations aimed at the digitalization of judicial files, complemented with the implementation of the PUMA system in the Labor, Civil and Civil jurisdictions. Family, allowing its operators to work on digital files simultaneously without restriction of days or hours.

Among the most notable aspects of the reform is the incorporation of the notification of the claim and the sentence to the provincial State in electronic form, the possibility of the preliminary hearing being optional, the total referral to the Code of Civil and Commercial Procedure in that concerns the recursive regime and the inclusion of Chapter XI referring to Tax Executions.

It is within this framework that Legislators Lucas Pica and Facundo López present this project to “comprehensively replace the text of Law P No. 5106, which will be drafted in the terms of the Annex to this Law.”
