Guerrero had repeatedly alerted the media about the possibility that Higuera Casallas would be released due to the constant postponements of hearings, which ultimately led to the expiration of terms. This situation benefited the woman, who will now face trial in freedom.

What happened?

The case of Samuel Guerrero, a boy from Bogotá whose lifeless body was found in the sea of ​​Santa Marta, has caused deep frustration in his father. Guerrero stated that, although the Prosecutor’s Office had sufficient evidence to advance the judicial process, delays in the hearings have allowed Higuera Casallas to remain free during the trial.

In her statements, the woman claims that Samuel’s death was an accident. However, authorities have presented evidence that directly incriminates her in the murder. According to the report of Legal Medicine and Forensic Sciences, the child died of asphyxiation due to prolonged immersion in water, contradicting his mother’s version.

“The Prosecutor’s Office could not hold the hearings when the court requested it. The court also set very distant dates, with the next hearing being August 30 (for the trial). “This is heartbreaking because justice is not being served, and these unjust actions encourage more injustice, as anyone who harms a child sees that they can go free,” Edwin Guerrero expressed helplessly, lamenting the lack of justice for his son.

The minor’s mother faces charges of aggravated murder, and the Prosecutor’s Office has requested a sentence of 500 to 700 months in prison. However, Guerrero fears that, being free during the trial, she could escape again.
