Through a circular, the sector announced this guideline for the 120 certified populations.

Tunja, June 19, 2024. (UACP). With the purpose of publicizing the legal requirements for the offer of formal education at the preschool, basic and secondary levels, as well as cycle education, informal education and education for work and human development in the non-certified municipalities of the department , the Secretary of Education, Eddye Reyes Grisales, announced circular 069 of June 13 of this year.

This document, addressed to municipal mayors, government secretaries, police inspectors, leaders of provincial educational units and rectors of educational institutions, provides guidelines to advance said process.

Firstly, the Secretary of Education of Boyacá requests collaboration to carry out the relevant controls against the illegal offer of formal education in several municipalities of the department. For this reason, the following must be taken into account:

1. Every private institution to offer formal education and/or high school validation must have an operating license as determined in article 2.3.2.1.2 of decree 1075 of 2015. (https://www.mineducacion.gov.co /portal/normatives/Decrees/351080:Decree-No-1075-of-May-26-2015)

2. The operating license legally issued by the Secretary of Education of Boyacá only authorizes the educational institution to offer the service in the municipality for which it was issued, upon presentation and approval of the Institutional Educational Project (PEI) proposal, attaching the concept of land use, health license, construction license and/or lease contract and certificate of approval of physical facilities by Inspection and Surveillance, among others.

3. For the specific case of private institutions that offer formal education through special school cycles (CLEI), or commonly called adult education, the operating license only authorizes them to offer this type of education in person or semi-presential, but guaranteeing minimum attendance, no less than 50% of the total of the 800 required annual hours, this is equivalent to 400 effective class hours.

4. Legally authorized formal adult education educational institutions are not permitted to offer any type of baccalaureate validation. The competence to validate the baccalaureate is solely and exclusively of the Colombian Institute for the Evaluation of the Quality of Education (ICFES), as determined by article 2.3.3.3.4.3.1 of decree 1075 of 2015.

5. Education for work and human development is that which is offered with the aim of complementing, updating and supplying knowledge through job training and academic training programs and only institutions that have previously obtained their license are authorized. operation and registration of programs, as contemplated in articles 2.6.3.2 and 2.6.4.6 of Decree 1075 of 2015.

6. The operating license issued to an educational institution for work and human development only gives it the right to offer programs registered in the municipality for which it was authorized. The opening of one or more locations in a different jurisdiction requires the processing of the license before the Ministry of Education of the competent territorial entity, as determined in article 2.6.3.6. of decree 1075 of 2015.

7. Informal education is that which aims to provide opportunities to complement, update, perfect, renew or deepen knowledge, skills, techniques and practices, it can be offered through courses of less than one hundred and sixty (160) hours, and do not lead to the granting of no title, it only gives rise to the issuance of a certificate of attendance, as determined in article 2.6.6.8 of the aforementioned decree.

Natural and/or legal persons who want to offer this type of education must comply with the provisions of circular 143 of November 28, 2018, issued by the Secretary of Education of Boyacá.

Due to the legal arguments presented and the possible impact on the community and educational institutions of the municipalities of the department of Boyacá, the sector asks the mayors to carry out the relevant administrative action for the closure of the educational institutions that offer services in any of them. the 120 non-certified municipalities of the department without an operating license from the Boyacá Secretary of Education.
