The federal judge Sebastian Casanello He once again urged the Government to hand over the files corresponding to the purchases of food collected in the Human Capital warehouses and also reminded him that the ruling of the Federal Chamber, yesterday, gave the ministry one day to present in the file the distribution plan of that food. This last point was not complied with by the Government, which requested successive extensions, but until now has not delivered them. For this reason, Casanello ordered him again yesterday to comply within 24 hours. This is key documentation for the case, which aims to determine whether there was a crime on the part of the public officials accused of having violated their duties regarding the distribution of that food. The files that the judge is requesting must include the rules and reasons that justified the purchase of the food and also the destination for which it was acquired. Therefore, it is a key test for researchers.

In parallel, Casanello demanded the distribution plan from Capital Humano – which had to be able to be executed immediately – based on the urgency implied by food being at stake in the midst of a serious food crisis.

When the Government appealed the judge’s decision, it argued that it implied “intrusion” by the Judicial Branch within the sphere of action of the National Executive Branch. He alleged that it is the Ministry of Human Capital that is responsible for executing the food security policy. Leila GianniPettovello’s representative in this case, also accused Casanello of being a “militant judge” and said, in front of the judges of the Federal Chamber, that “no judge” was going to tell the Government what its food policy should be.

Given the confirmation of the Federal Chamber of the judge’s decision, Capital Humano reported that it will present everything required. The chambermaids Martín Irurzun, Eduardo Farah and Roberto Boico signed yesterday’s ruling.

Farah reaffirmed this instruction to Casanello: he said that if the Government ignores the Chamber’s ruling, he must “assume the obligation to file the corresponding criminal complaint.” Also, it will have to exhibit “greater interference”, appealing to the help of the public force to “access the custody of the merchandise and for its immediate disposal through the entities that best and fastest serve to ensure that the food reaches the most needy.”

In his vote, Farah also said that the Government had chosen to “question the judicial ‘interference’, curiously through a procedural appeal before another ‘judicial’ authority”, and stated: “At this point it is worth asking how many ‘judicial’ instances it is before. “The Ministry is willing to go so far as to understand that it is the responsibility of this State Power to control government acts when decisions (or omissions) affect people’s rights and there are means available to satisfy those rights.”

Irurzun, in his vote, also supported the precautionary measure and warned that there was still food to be distributed “whose expiration date is close,” but he also instructed the judge to “adjust and redirect the investigation in accordance with the criminal object reported”; that is, the alleged failure to fulfill the duties of the officials regarding the distribution.
