The sixth court denied the protection that deputy Manuel García had filed against the Mayor’s Office of Caucasia and the third police inspection of that municipality, asking that the rights of more than 5 thousand families that are settled on the Santa Helena property be protected, which already had an order to be evicted on May 28.

The deputy’s request, through the guardianship, was to “protect the fundamental rights of the community settled on the Hacienda Santa Helena property, so that the Municipal Administration of Caucasia and the Third Police Inspection of Caucasia be ordered to accept the request for withdrawal sent by the SAE as administrator of the lot known as Hacienda Santa Helena and consequently, through an administrative act, the termination of the police process is declared.”

According to the court’s decision, This would not be the appropriate mechanism to seek to stop the administrative processes that are already underway regarding the invasion of this property, in which the municipal administration of Caucasia has indicated that social and health problems are already being recorded.

The deputy assured that will challenge the ruling before the corresponding courts, so that another assessment can be given in a second instance. He also assured that he will request intervention from the Ombudsman’s Office.

“We wait for the second instance decision to be the court in Medellín Superior or the Supreme Court in Bogotá. It may take us a few months. Meanwhile, I have faith that with the help of the National Government, with the entities that are in the process, for example, the SAE and others to whom we have written, MinVivienda, MinInterior, “We will soon be able to sit at a dialogue table and find alternative solutions for those who really need it.”

What will happen with the eviction order?

With the denial of guardianship, the measure previously decreed, which stopped the eviction, also falls. which was going to take place on May 28. However, so far, says the deputy, the Police inspection has not resumed the order.

“The Police inspector has not yet spoken out and this gives us a moment of waiting and we hope a solution can be found to this huge problem because there are thousands of people there.”
