The driver who killed the motorcyclist on Camino del Buen Ayre was charged with manslaughter: what he declared in court

A 28-year-old motorcyclist, identified as Pablo Ariel Santillán, died this Thursday in a multiple crash that occurred on the Camino del Buen Ayre. Due to the incident, the driver who caused the accident, Carlos Andrés Dip (45), was arrested and charged with “aggravated manslaughter”. According to the researchers, she had 1.97 grams of blood alcohol at the time of the event.

This Friday, in the investigation at Prosecutor’s Office No. 1 of Ituzaingó, The accused refused to testify and his lawyerRodrigo Tripolone, announced that he will present his resignation from his defense.

The incident was recorded on highway security cameras. In these images, it is observed that the Renault Stepway, driven by Dip, left the lane first and collided with a Peugeot Partner. That made him to lose control and hit the motorcyclist who was traveling on the right hand side, in the fast lane, towards the Panamericana.

After the impact, the victim was thrown from the motorcycle, flew over the guardrail and landed on the opposite side, where was hit by a Toyota Corolla that failed to stop in time. The SAME quickly arrived at the scene, but could only confirm the death of the victim.

How the case continues

Prosecutor Marcelo Tavolaro investigated the accused for the crime of “aggravated manslaughter,” which provides for a penalty of up to six years in prison, although he refused to testify. Likewise, the magistrate requested preventive detention.

An alternative that Justice can choose is the figure of “simple homicide with possible intent“, which can be applied in cases in which a person is aware that, with certain behavior, he understands that he can cause the death of a third party, he does nothing to prevent it. This position provides a sentence of 8 up to 25 years in prison.

The government of the province of Buenos Aires suspended the driver’s license of Carlos Dip, who will continue to be detained, for the moment, at the 2nd Police Station of Ituzaingó.
