The Second Section of the Provincial Court of Córdoba has sentenced MB, a 25-year-old citizen, to four years in prison for a crime of sexual abuse and a minor crime of injuries. The events occurred on August 23, 2021, when the accused sexually assaulted the victim, after the latter decided not to continue with a consensual sexual encounter. Additionally, MB punched the victim in the face during a subsequent altercation.
The ruling, to which this newspaper has had access, also prohibits the convicted person from communicating or approaching the victim for the next six years, and from paying a fine of 300 euros for the minor crime of injuries.
According to the proven facts, reported in the sentence, MB took the victim to a secluded place where, after a change of decision on the part of this man not to continue with the sexual act, he proceeded to sexually assault him without his consent. Later, in an altercation, MB hit this man, causing a facial injury.
According to the Prosecutor’s Office brief, which requested a sentence of seven years in prison, the events occurred in the Alcolea neighborhood in August 2021. At an undetermined time, the accused was with a group of friends when the police arrived at the same place. victim with a friend, both groups engaging in conversation.
During the conversation between the accused and the young man, both decided to drive in the latter’s car to an area of the neighborhood in order to have sexual relations. However, once they began touching each other inside the vehicle, the complainant decided that he did not want to continue due to the defendant’s abrupt behavior. Furthermore, according to the Public Ministry’s letter, the young man explicitly told him that he did not want to continue with the sexual contact.
