After the Ombudsman’s Office established a guardianship to protect the right to health of 15 minors residing in the municipality of Puerto Libertador, the Promiscuous Family Court of Montelíbano issued a first instance ruling in favor. As a result, it was ordered that health services must be provided in that area of southern Córdoba, instead of Montería, as had been done previously.
For this purpose, the Family Court of Montelíbano considered the transfer that the minors and their companions had to make to the capital of the department, the transportation costs and the school days that they lost due to traveling three times a week, which meant a significant economic and physical drain on these families.
The judicial action was taken after a protection established by the Southern Regional of Córdoba against the Nueva EPS, which decided to transfer the services it had been providing in Puerto Libertador to Montería on January 31, which would have triggered trauma in the therapies provided. in the best of age, since their fundamental rights to health, a dignified life, minimum living standards and childhood were being violated.
Among the provisions issued against the New EPS are that it guarantees health services for minors in the municipality of Puerto Libertador, with any IPS of that population. Likewise, the Court requested comprehensive health care for the provision of the service to all minors and consequently their individual care be available without restrictions within the urban area of Puerto Libertador, as was being done until January 31, 2024.
Likewise, it was also ordered that the Zonal Management in Córdoba of the Nueva EPS, within a period of 15 days after notification of this ruling, sign the agreement or agreements necessary for the provision of health services required by minors. of age in the municipality of Puerto Libertador and to do so, you must hire an IPS located in that municipality that provides such services effectively.
Within the scope of guardianship, it is also for the New EPS to authorize and cover the round-trip transportation costs of the protected minors and a companion, for each one, whenever they inevitably have to travel outside their place of residence, to receive services. doctors related to their pathologies, from the municipality of Puerto Libertador.
