This Friday, the Inter-American Court of Human Rights (IACHR Court) blamed the Argentine State for the attack perpetrated in 1994 against the Argentine Israelite Mutual Association (AMIA) in Buenos Aires for not having taken the relevant measures to prevent the attack, which resulted in 85 dead and hundreds injured. Thus, the court has indicated in a statement that Argentina is responsible for “not having adopted reasonable measures to prevent the attack, which will be 30 years old in July, and for not having fulfilled its duty to investigate with due diligence and the attack and its cover-up within the corresponding period”. Judge Nancy Hernández López stated during the reading of the court’s ruling that based on the complaint filed five years after the attack by the victims’ relatives, it can be pointed out that Argentina “did not guarantee real access to the documentation” about what happened that day. “The violation of the right to the truth was determined due to the multiple deficiencies in the determination of the historical truth about the attack and the direct responsibility for the cover-up maneuvers,” states the text, which highlights the existence of difficulties on the part of the relatives when accessing pertinent information. In this way, the court has unanimously resolved to point to the responsibility of the Argentine State and determine its involvement in the violation of the rights to life and personal integrity, to the detriment of the victims of the attack. As a result of this ruling, the court has ordered Argentina to remove “all obstacles that maintain total impunity in this case” and has urged the country to initiate and reopen “the necessary investigations to prosecute and punish those responsible for the events.” and establish the truth of what happened.” In turn, it has given the country a period of one year to report to the court and implement the measures adopted.
